End-User License Agreement for HamOrbit Control Center.

By downloading, installing or using HamOrbit Control Center ("the Software"), you accept the terms of this End-User License Agreement ("EULA"). If you do not accept these terms, do not install or use the Software.
HamOrbit grants you a non-exclusive, non-transferable and revocable license to install and use the Software on your personal devices as a licensed amateur radio operator.
The Free version is free and permanent. The Plus and Pro versions, when available, will require a valid annual subscription.
You may NOT:
The Software is owned by HamOrbit and protected by copyright laws. The grant of this license does not transfer any ownership of the Software or its source code.
Your QSO database, settings and logs are stored locally on your device. HamOrbit does NOT transmit this data to our servers except when you explicitly enable synchronization features (Plus/Pro plans).

HamOrbit uses public and free third-party APIs (hamqsl.com, BrandMeister, DXSummit, CelesTrak, etc.). Use of these APIs is governed by their own terms of service. HamOrbit is not responsible for the availability, accuracy or changes of these APIs.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
HamOrbit does not warrant that the Software is error-free, uninterrupted, or that it will meet all your specific requirements.
IN NO EVENT SHALL HAMORBIT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
HamOrbit’s total liability under this agreement shall not exceed the amount paid for the Software during the 12 months preceding the incident (or €0 for the Free version).
As a user, you are solely responsible for complying with all local amateur radio regulations, including but not limited to:
This license is valid until terminated. Your rights under this license terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must destroy all copies of the Software.

This Agreement is governed by the laws of Spain. Any dispute arising from this Agreement shall be submitted to the exclusive jurisdiction of the courts of Madrid.
HamOrbit reserves the right to modify this EULA at any time. Modifications will be published at hamorbit.com/license with the updated revision date. Continued use of the Software after changes constitutes your acceptance of the new terms.
